User Agreement & Platform Rules

Definitions

For the purposes of these Terms & Conditions, the following definitions apply:

• "38win" or "the Platform" refers to the online casino and sports betting service operated at 38win.im, including all games, betting markets, promotions, and associated services made available to registered users.
• "You" or "the Player" refers to any individual who accesses, registers on, or uses the 38win platform in any capacity.
• "Account" means the individual registered user account created by a Player upon successful completion of the 38win registration process.
• "Balance" means the total of deposited funds and any credited bonus amounts held in a Player's Account at any given time, denominated in Pakistani Rupees (PKR).
• "Wager" or "Bet" means any real-money stake placed by a Player on a game outcome, sporting event, or other betting market made available on the Platform.
• "Bonus Funds" means promotional credits granted by 38win to a Player's Account subject to wagering requirements and promotional terms.
• "Wagering Requirement" means the number of times a Player must wager an amount before bonus-derived winnings become eligible for withdrawal.
• "KYC" means Know Your Customer — the identity and age verification process that 38win is entitled to require of any Player at any time.

Acceptance of Terms

By accessing the 38win platform, creating an Account, or placing any Wager, you confirm that you have read, understood, and agreed to be legally bound by these Terms & Conditions in their entirety, together with the 38win Privacy Policy and any game-specific or promotion-specific rules published on the Platform.

If you do not agree with any provision of these Terms, you must immediately discontinue your use of the Platform and, if you hold an Account, contact 38win support to arrange closure of your Account and withdrawal of any remaining eligible Balance.

Account Registration

To access real-money features of the 38win platform, including placing Wagers and making deposits, you must first register an Account. Registration requires the provision of accurate, complete, and current information including your full legal name, date of birth, residential address, and valid contact details.

• One Account Per Player: Each individual is permitted to hold only one registered Account on the 38win platform. The creation of duplicate or multiple Accounts by the same individual — whether using the same or different registration details — is strictly prohibited and will result in suspension of all associated Accounts and forfeiture of any Balances pending investigation.
• Accurate Information: You are solely responsible for ensuring that all information provided at registration and during any subsequent KYC process is truthful and accurate. Providing false information constitutes a material breach of these Terms.
• Account Security: You are responsible for maintaining the confidentiality of your Account login credentials. You must not share your username or password with any third party. 38win will not be liable for any losses arising from unauthorised access to your Account resulting from your failure to maintain credential security.
• Account Transfer: Accounts are personal and non-transferable. You may not sell, transfer, or assign your Account or any rights associated with it to any other person.

38win reserves the right to request documentary proof of identity, address, and payment method ownership at any point during your account lifecycle. Failure to provide requested documentation within a reasonable timeframe may result in Account suspension and withholding of withdrawals pending verification.

Age Verification & Eligibility

The 38win platform is strictly for adults. You must be at least 21 years of age to register an Account, make a deposit, or place any Wager on the Platform. This age restriction is enforced without exception.

In addition to the age requirement, you represent and warrant that:

• You are accessing the Platform from a jurisdiction where online gaming is not prohibited by applicable law.
• You are not accessing the Platform as an agent or on behalf of any other person.
• You are not a current employee, contractor, or immediate family member of an employee of 38win or any associated entity.
• You have not previously been self-excluded from the 38win platform or any affiliated platform and are not currently subject to any self-exclusion order.

Deposits & Withdrawals

All financial transactions on the 38win platform are conducted in Pakistani Rupees (PKR). 38win supports the following deposit and withdrawal methods for Pakistani Players: JazzCash, EasyPaisa, HBL Bank Transfer, UBL Bank Transfer, Meezan Bank Transfer, Visa, and Mastercard.

Deposits: Deposits are credited to your Account Balance upon successful confirmation from the relevant payment provider. 38win does not accept deposits from third-party accounts — the payment method used must belong to the registered Account holder. Minimum and maximum deposit thresholds apply and are displayed in the cashier section of the Platform at the time of transaction.

Withdrawals: Withdrawal requests are processed to the same payment method used for the most recent deposit, wherever technically possible, in compliance with anti-money-laundering obligations. Withdrawal requests may be subject to KYC verification before processing. 38win aims to process approved withdrawal requests within the timeframes published in the Platform's help section, but processing times may vary depending on the payment provider.

• Withdrawals of Bonus Funds are subject to applicable wagering requirements being met in full prior to processing.
• 38win reserves the right to request additional verification documentation before processing any withdrawal request.
• Withdrawal requests made using a payment method different from the deposit method may be subject to additional review.
• 38win will not be liable for delays caused by third-party payment processors, banking systems, or network outages beyond our reasonable control.

Betting Rules

All Wagers placed on the 38win platform are subject to the general betting rules set out below, as well as any sport-specific or game-specific rules published within the relevant section of the Platform. In the event of a conflict between these general rules and sport-specific rules, the sport-specific rules shall prevail.

• Bet Acceptance: A Wager is only valid and binding once it has been confirmed by the 38win system and a confirmation reference has been issued. Wagers that have not received a confirmation reference are not valid, regardless of any funds deducted from your Balance at the time of attempted placement.
• Minimum & Maximum Stakes: Minimum and maximum stake limits apply to all markets and are displayed within the relevant betting interface prior to Wager placement.
• Void Bets: 38win reserves the right to void any Wager where it is determined that a manifest pricing error occurred, where a market was offered in error, or where there is credible evidence of match-fixing or event manipulation.
• In-Play Betting: In-play Wagers are accepted subject to real-time market availability. Latency between live events and the Platform interface is an inherent characteristic of in-play betting; 38win does not guarantee uninterrupted in-play market availability.
• Cricket & PSL Markets: All cricket betting markets, including Pakistan Super League markets, are subject to the official results declared by the relevant governing body. Wagers will be settled in accordance with those official results.

Bonuses & Promotions

38win offers bonuses and promotional incentives to new and existing Players from time to time. All bonuses are governed by these Terms and any specific promotional terms published alongside each individual offer. Where a conflict exists between these Terms and promotional terms, the promotional terms shall take precedence for that specific offer.

• Wagering Requirements: Unless explicitly stated otherwise in the promotional terms, bonus funds must be wagered the specified number of times before any winnings derived from bonus funds become eligible for withdrawal.
• Bonus Expiry: All bonuses are subject to an expiry period. Unused bonus funds and any associated winnings will be forfeited upon expiry of the stated period.
• One Bonus Per Player: Promotional offers are intended for one use per Player, per household, and per shared device or IP address unless explicitly stated otherwise.
• Abuse: Any attempt to abuse, manipulate, or exploit 38win's bonus system — including but not limited to creating multiple Accounts, collusion with other Players, or exploiting software errors — constitutes a material breach of these Terms. 38win reserves the right to forfeit any bonus or associated winnings and close any Account found to be engaged in bonus abuse.

Prohibited Conduct

The following conduct is strictly prohibited on the 38win platform. Engagement in any prohibited conduct constitutes a material breach of these Terms and may result in immediate Account suspension, forfeiture of Balance, and reporting to relevant authorities:

• Registering more than one Account on the Platform.
• Providing false, misleading, or fraudulent information at registration or during any verification process.
• Using the Platform if you are under 21 years of age.
• Depositing funds obtained through fraudulent, illegal, or unauthorised means.
• Using third-party software, bots, scripts, or automated systems to interact with the Platform.
• Exploiting technical errors, bugs, or pricing mistakes in any game or betting market.
• Engaging in money laundering, structuring transactions to avoid detection thresholds, or using the Platform for any financial crime purpose.
• Harassing, threatening, or abusing 38win staff or other Platform users.
• Attempting to reverse-engineer, copy, or replicate any component of the 38win platform.
• Placing Wagers on behalf of, or in collusion with, any other person for the purpose of guaranteeing outcomes or exploiting promotional offers.

Intellectual Property

All content on the 38win platform — including but not limited to software, game content, graphics, logos, trademarks, text, layout, and data compilations — is the intellectual property of 38win or its licensed content providers and is protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform for personal, non-commercial entertainment purposes only. This licence does not permit you to reproduce, distribute, modify, publicly display, or create derivative works from any Platform content without the prior written consent of 38win.

Privacy & Data

38win collects and processes personal data in accordance with its Privacy Policy, which is incorporated into these Terms by reference. By accepting these Terms, you confirm that you have also read and accepted the 38win Privacy Policy.

38win may share your personal data with third-party payment processors, identity verification providers, and regulatory or law enforcement authorities where required by law or where necessary to protect the integrity of the Platform and its users. 38win will not sell your personal data to unaffiliated third parties for marketing purposes.

Responsible Gaming

38win is committed to promoting responsible gaming practices across its entire player base. We recognise that for a small proportion of players, gambling can become problematic, and we take our obligations in this area seriously.

• Deposit Limits: Players may set daily, weekly, or monthly deposit limits on their Account at any time via the account settings section. Reductions to deposit limits take effect immediately; increases are subject to a cooling-off period.
• Session Time Reminders: Players may configure session time reminders to receive notifications after a specified period of continuous play.
• Cooling-Off Periods: Players may request a temporary cooling-off period — a short-term suspension of their Account — at any time by contacting 38win support.
• Self-Exclusion: Players who believe their gambling has become problematic may request permanent self-exclusion from the 38win platform. Self-exclusion requests are processed by the 38win support team and, once activated, cannot be reversed for the duration of the exclusion period.

Limitation of Liability

To the fullest extent permitted by applicable law, 38win shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Platform — including but not limited to loss of winnings, loss of data, or loss of business opportunity.

38win's total aggregate liability to any Player in connection with any claim arising under or in connection with these Terms shall not exceed the total amount deposited by that Player in the thirty (30) days immediately preceding the event giving rise to the claim.

38win does not warrant that the Platform will be available without interruption, error-free, or free from viruses or harmful components. Scheduled and emergency maintenance may result in temporary Platform unavailability. 38win will make reasonable efforts to notify Players of planned maintenance in advance.

Nothing in these Terms shall limit 38win's liability for death or personal injury caused by its negligence, or for fraud or fraudulent misrepresentation.

Amendments to Terms

38win reserves the right to amend, update, or replace these Terms & Conditions at any time. Where amendments are material, 38win will provide reasonable notice to Players via the email address registered to their Account and/or via a prominent notice on the Platform prior to the amendments taking effect.

Your continued use of the Platform following the effective date of any amendment constitutes your acceptance of the revised Terms. If you do not agree with an amendment, you must stop using the Platform and close your Account prior to the effective date of the change.

Governing Law & Dispute Resolution

These Terms & Conditions are governed by and construed in accordance with the laws applicable to the jurisdiction under which 38win holds its operating licence. Any dispute arising out of or in connection with these Terms that cannot be resolved through good-faith negotiation between the parties shall be submitted to binding arbitration in accordance with the rules of the applicable licensing authority.

For disputes relating to individual Wager settlements, Players must first raise the matter with the 38win customer support team. If the dispute is not resolved at first-instance support level, it may be escalated to the 38win disputes team for formal review. 38win's decision following formal review is final and binding, subject to any rights of appeal available under applicable licensing regulations.

Nothing in this clause shall prevent either party from seeking emergency injunctive or other equitable relief from a court of competent jurisdiction where necessary to prevent irreparable harm.
